This Privacy Policy explains how I LIKE BASIC PTY LTD (“Company,” “we,” “us,” or “our”) collects, uses, stores, and protects your personal information when you use misconception.ai (“Service”). We are committed to protecting your privacy and handling your data responsibly.
1. Information We Collect
1.1 Information You Provide
- Account Information: Your email address and password when you create an account, or, when you sign in with Google, the name, email address and profile picture of your Google account. Passwords are handled by our authentication provider; we never see them
- Conversations: The messages you send to the AI agent and its replies, together with pictures of your scene as it is shown in your browser, which go with your messages so that the agent can see what you see
- Creations: The scenes you make with the Service, including their titles, steps, narration and rendered images (“renders”), and whether you have made each of them public
- Communications: Information you provide when contacting us
The Service is free and has no paid plans, so we do not collect payment information.
1.2 Information Collected Automatically
- Usage Data: How much of the AI features of the Service each account uses each day, and what that use cost us, which is how usage quotas are applied
- Log Data: IP address, browser type, access times and the requests made to the Service, recorded by our hosting infrastructure
- Browser Storage: The Service keeps you signed in, and remembers a few display preferences (such as whether labels are shown), using your browser’s local storage
- Analytics: We use Google Analytics to understand how the Service is used: which features are used, on what kind of device and browser, and similar events. It runs without cookies and stores nothing on your device. Use by a signed-in account is attributed to it by an internal identifier only, never by name or email, and no event carries the contents of your scenes or messages. Google’s handling of this data is governed by its privacy policy
We do not use advertising cookies, and we do not use tracking for advertising.
2. How We Use Your Information
We use your information to:
- Provide the Service: Process your requests, build and change scenes, generate narration and renders, and deliver the features you use
- Manage Your Account: Create and maintain your account and keep your Creations for you to come back to
- Apply Usage Quotas: Count usage to apply quotas, prevent abuse, and ensure fair access for all users
- Share What You Make Public: Show a Creation you have made public to anyone who has its link, and feature public Creations on the Service’s website
- Improve the Service: Understand how the Service is used, fix problems, and develop new features
- Communicate with You: Send service updates and respond to inquiries
- Ensure Security: Detect and prevent fraud, abuse, and security threats
- Comply with Legal Obligations: Meet applicable legal requirements and respond to legal requests
3. Data Storage, Visibility and Retention
3.1 Where Your Data is Stored
Your data is stored on secure cloud infrastructure provided by Google (Firebase and Google Cloud). Data may be processed in various locations, including the United States, Australia, and other countries where our service providers operate. We ensure appropriate safeguards are in place for international data transfers.
3.2 Who Can See Your Content
Your Creations are private unless you make them public. Your conversations with the AI agent are never shown to other users, whether a Creation is public or not.
- Private Creations: Shown to no other user
- Public Creations: When you make a Creation public, anyone who has its link can view its scene and renders and listen to its narration, with or without an account. The link contains an identifier of your account; it does not reveal your name or email address
- Featured Creations: Any public Creation may be featured on the Service’s website at our discretion, for example in the gallery on the front page, where every visitor can see it and open it, and where search engines may list it. A featured Creation is shown by its title and one of its renders; we do not show your name or email address with it
- Making a Creation Private Again: Its link stops working and it is removed from where it was featured. We cannot recall copies that others made while it was public
- Render Images: Images are loaded through long, unguessable links. Anyone you give such a link to can open that image
- Our Staff: Authorised staff may view scenes and renders, including private ones, to operate, support and moderate the Service and to choose what to feature (only public Creations are ever featured). Our administration tools do not show conversations; we access those only where needed to investigate a problem, abuse, or a legal request
Do not put personal, confidential or sensitive information into a Creation that you intend to make public. See our Terms of service for the rules that apply to public and featured Creations.
3.3 Retention Period
We retain your personal information for as long as your account is active or as needed to provide the Service. When you delete a Creation, its scene, its conversation and its renders are deleted. Generated narration audio is kept by its text alone, not linked to your account, so that the same words need not be generated twice. After account deletion, we may retain certain information, such as usage records, as required by law or for legitimate business purposes (such as preventing abuse, resolving disputes or enforcing our agreements).
4. Data Sharing
We do not sell your personal information. We may share your information with:
- Service Providers: Third parties who help us operate the Service, including Firebase and Google Cloud (sign-in, hosting, databases, file storage, analytics and infrastructure)
- AI Model Providers: Your messages, your scenes and pictures of them are processed by AI models from Anthropic (Claude), Google (Gemini) and OpenAI to build scenes, generate narration and make renders. These providers act under their own terms: Anthropic, Google and OpenAI
- The Public: Creations you choose to make public, as described in section 3.2
- Legal Requirements: When required by law, court order, or government request
- Business Transfers: In connection with a merger, acquisition, or sale of assets
- With Your Consent: When you explicitly authorize sharing
5. Your Rights and Choices
5.1 Access and Portability
You can access your Creations and conversations through the Service. You may request a copy of your personal data in a portable format.
5.2 Correction
You can change your Creations directly through the Service. For other corrections, please contact us.
5.3 Deletion
You have the right to delete your data. You can delete any of your Creations in the Service at any time. You can request deletion of your account and associated data by contacting us at support@misconception.ai. Upon request, we will delete your personal information, conversations and Creations, except where retention is required by law or for legitimate business purposes.
5.4 Sharing Choices
- Public Creations: Making a Creation public is your choice, and you can make it private again at any time
- Featuring: If you do not want a Creation to be featured, keep it private. Making a featured Creation private again removes it from where it is featured. You may also ask us to stop featuring a Creation by contacting us
- Marketing Communications: We do not currently send marketing emails. If that changes, you will be able to unsubscribe using the link provided in each email
- Browser Storage: You can clear what the Service stores in your browser through your browser settings; doing so signs you out
5.5 Account Restriction
You may request that we restrict processing of your data in certain circumstances, such as when you contest the accuracy of the data.
6. Security
We implement industry-standard security measures to protect your data, including:
- Encryption of data in transit and at rest
- Access controls and authentication requirements
- Rules that keep each user’s private Creations and conversations from other users
- Secure coding practices and vulnerability management
While we strive to protect your information, no method of transmission or storage is completely secure. You are responsible for maintaining the confidentiality of your account credentials.
7. Children’s Privacy
The Service is not intended for users under 18 years of age. We do not knowingly collect personal information from children. If we learn that we have collected data from a child, we will delete it promptly.
8. Third-Party Links and Content
The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies before providing any personal information.
9. AI Processing
When you use the Service:
- Your messages, your scenes and pictures of them are processed by AI models from Anthropic, Google and OpenAI to build scenes, generate narration and make renders
- Under the terms of the paid API services we use, these providers do not use your content to train their models. They may retain it for a limited time for safety and abuse monitoring, as described in their own policies
- We do not use your content to train our own AI models without your explicit consent
- Generated scenes, narration and renders are stored in your account for you to come back to
10. International Users
If you are accessing the Service from outside Australia, please note that your data may be transferred to and processed in Australia, the United States or other countries. By using the Service, you consent to such transfers. We ensure appropriate safeguards are in place to protect your data regardless of where it is processed.
11. Australian Privacy Principles
We comply with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). Australian residents have additional rights under this legislation, including the right to:
- Know what personal information we hold about you
- Access and correct your personal information
- Complain about a breach of the APPs
12. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Service and updating the “Effective date.” Your continued use of the Service after changes constitutes acceptance of the updated policy.
