Terms of service

Welcome to misconception.ai (“Service”), a product of I LIKE BASIC PTY LTD (“Company,” “we,” “us,” or “our”), an Australian company. By accessing or using our Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.
1. Description of Service
misconception.ai is an AI-powered visualization tool. You describe something you want to understand, and an AI agent builds an interactive 3D scene that explains it step by step. The Service can also read a scene’s steps aloud and make rendered images of a scene (“renders”). Scenes, their explanations, their narration and their renders are generated by artificial intelligence.
Important: AI-generated scenes, explanations, narration and renders may be inaccurate, incomplete, simplified or misleading. The Service is intended for illustration and general understanding only, not as a replacement for professional advice, formal instruction or authoritative sources.
2. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Account Registration
You can look at examples and at scenes that others have made public without an account. To make scenes of your own, you need to create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security and confidentiality of your login credentials
- Promptly notify us of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
- Use the account for your individual use only; sharing login credentials or account access with others is prohibited
- If multiple people in your organization need access, each person must create their own account
4. Free Service and Usage Quotas
The Service is currently provided free of charge. There are no paid plans, and we do not ask for your payment details.
Because the Service is free, your use of it is limited by usage quotas:
- Quotas limit how much each account may use the AI features of the Service (such as building and changing scenes, narration and renders) in a given period, and how much all users may use them together
- When a quota is reached, the Service may refuse further requests until the quota resets. This can happen because of overall demand, even when you have used little of the Service yourself
- Use by others of what you make public, such as narration played for someone viewing your public scene, may count toward your quota
- We may set, change, or apply different quotas to different accounts at any time, at our discretion and without notice
- Quotas are not an entitlement; we do not guarantee that any particular amount of use will be available to you
- Unused quota does not carry over, is non-transferable and has no cash value
We may introduce paid plans or paid features in the future. If we do, we will tell you beforehand, and you will not be charged unless you choose to buy something.
5. Your Creations and Sharing
“Creations” are the scenes you make with the Service, including their titles, steps, narration and renders.
5.1 Private by Default
Every Creation starts out private: it is not shown to other users. Our own access to your content is described in our Privacy policy.
5.2 Making a Creation Public
You may choose to share a Creation by making it public. When you do:
- Anyone with its link can view the scene and its renders and listen to its narration, with or without an account, and can pass the link on to others
- Viewers cannot change your Creation, and your conversation with the AI agent is not part of what is shared
- You may make the Creation private again at any time, after which its link stops working. We cannot recall copies, screenshots or downloads that others made while it was public
- You are responsible for what you make public. Do not make public a Creation that contains personal, confidential or sensitive information, or content you do not have the right to share
5.3 Featured Creations
Any public Creation may be featured on the Service’s website, for example in the gallery on the front page, at the sole discretion of the Company.
- We decide which public Creations are featured, how they are presented and for how long, and may stop featuring one at any time
- A featured Creation is shown to every visitor of the website, and may be listed by search engines
- We are under no obligation to feature any Creation
- Featuring a Creation does not entitle you to payment, credit or any other compensation
- Featuring a Creation does not mean that we have verified its content or endorse it
- If you do not want a Creation to be featured, keep it private. Making a featured Creation private again, or deleting it, removes it from where it is featured
5.4 Licence You Grant Us
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process and display your Creations and the content you submit, as needed to provide the Service to you.
For each Creation you make public, you also grant us a non-exclusive, worldwide, royalty-free licence to publicly display, reproduce, distribute and promote that Creation on the Service’s website, including by featuring it, and you allow anyone to view it there. This additional licence ends when you make the Creation private again or delete it, except that copies may remain in backups and caches for a reasonable time afterwards.
5.5 Removal
We may remove any Creation, make it private, or stop featuring it at any time and at our discretion, including where we believe it violates these Terms or applicable law. If you believe a public Creation infringes your rights or violates these Terms, please contact us at support@misconception.ai.
6. Usage Restrictions and Acceptable Use
You agree NOT to use the Service to:
- Conduct any illegal activity or violate any applicable laws or regulations
- Generate, distribute, or make public content that is harmful, abusive, harassing, threatening, sexually explicit or otherwise objectionable
- Produce content that promotes discrimination, hatred, or violence against individuals or groups
- Create deceptive content intended to mislead others, including about its AI-generated nature or its accuracy
- Engage in activities that could harm minors
- Infringe upon the intellectual property or privacy rights of third parties, including by making public a Creation that contains another person’s personal information
- Attempt to reverse engineer, decompile, or extract the underlying AI models
- Circumvent usage quotas, throttling mechanisms, or access controls, including by creating multiple accounts
- Use automated systems to access the Service, or to scrape or bulk-download its content, including public Creations, the gallery and the library of 3D models
- Resell, redistribute, or sublicense access to the Service without authorization
- Generate content for high-stakes decisions in healthcare, legal, financial, engineering, safety or similar domains without appropriate professional oversight
Prohibited Uses: Using the Service for any illegal or unethical purposes is strictly prohibited. We reserve the right to remove content and to suspend or terminate accounts that violate these restrictions without prior notice.
Fair Use Policy
In addition to the usage quotas, the Service is subject to a fair use policy:
- The Service is intended for normal, individual human use
- Usage that is automated, programmatic, or significantly exceeds typical human usage patterns may be considered abuse
- We reserve the right to throttle, suspend, or restrict accounts exhibiting abusive usage patterns
- We will make reasonable efforts to notify you before taking action, except in cases of severe or ongoing abuse
7. AI-Generated Content and Limitations
You acknowledge and agree that:
- Scenes, explanations, narration and renders are generated by AI and do not come from a human expert
- AI output may contain errors, inaccuracies, omissions, biases, or hallucinations
- Scenes are simplified illustrations. They may not be to scale, physically or technically accurate, complete, or up to date
- Renders are AI-made images based on a scene. A render may differ from its scene, and may add, change or leave out details
- You are solely responsible for verifying and validating anything you learn or take from the Service
- The Service should not be used as the sole basis for medical, legal, financial, engineering, safety or other important decisions
- Due to the non-deterministic nature of AI, the same request may give different results, and similar requests from different users may give similar results. We do not guarantee that your Creations are unique
- Public and featured Creations are made by users of the Service. They are those users’ content, and we do not review them for accuracy
- AI-generated output may inadvertently reproduce, resemble, or be derived from copyrighted material, trademarks, or other intellectual property of third parties; you are solely responsible for ensuring that any output you use, publish, or distribute does not infringe third-party rights
Accuracy Disclaimer: While best effort is taken to make scenes that explain their subject correctly, due to the inherent limitations of AI, no guarantee is made regarding the accuracy, completeness or fitness for any purpose of any scene, explanation, narration or render.
8. Intellectual Property
The Service, including its design, code, features, and library of 3D models, is owned by I LIKE BASIC PTY LTD or its licensors and protected by intellectual property laws. You retain ownership of content you input into the Service.
Your Creations may be used by you for lawful purposes, subject to these Terms. We do not claim ownership of AI-generated output, but we also make no warranties regarding originality or non-infringement. We make no guarantees that AI-generated output is free from third-party intellectual property claims; you are responsible for your use of any output from the Service. Renders made by the Service may carry a misconception.ai watermark.
9. Privacy
Your use of the Service is also governed by our Privacy policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE
- ACCURACY, RELIABILITY, or COMPLETENESS of any content or results
- UNINTERRUPTED or ERROR-FREE operation
- SECURITY or FREEDOM from viruses or harmful components
We do not warrant that AI-generated scenes, explanations, narration or renders will meet your specific needs, be accurate, or be suitable for any particular use case.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
I LIKE BASIC PTY LTD, its directors, employees, partners, and affiliates shall NOT be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from reliance on AI-generated content
- Damages resulting from decisions made based on Service output
- Damages arising from content you chose to make public, or from Creations made public by other users
The Service is provided free of charge. Our total aggregate liability for any claims arising from or related to the Service shall not exceed AUD $100.
These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law or other applicable laws.
12. Indemnification
You agree to indemnify, defend, and hold harmless I LIKE BASIC PTY LTD and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit to or generate through the Service, including any Creation you make public
13. Modification of Service and Terms
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We may also update these Terms periodically. We will provide at least 14 days’ notice of material changes, via email or through the Service. If you do not agree with the changes, you may stop using the Service and ask us to delete your account before they take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the modified Terms.
14. Termination
Termination of your account may occur in the following ways:
- By us, for cause (violation of these Terms, abuse, or illegal activity): we may suspend or terminate your access immediately, without notice
- By us, without cause: we will make reasonable efforts to give you at least 14 days’ notice
- By you: you may stop using the Service at any time, and may ask us to delete your account by contacting us at support@misconception.ai
Upon termination:
- Your right to use the Service immediately ceases
- Your public Creations are no longer shown, and are removed from where they were featured
- We may delete your account data in accordance with our Privacy Policy
- Provisions that should survive termination (such as limitation of liability) will remain in effect
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the courts of New South Wales, Australia. You waive any objection to venue in these courts.
16. Service Availability
We do not guarantee that the Service will be available at all times. The Service may be subject to interruptions, delays, or errors, and may refuse requests while usage quotas are reached. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any loss or damage resulting from Service unavailability.
17. Third-Party Services
The Service relies on third-party providers, including AI model providers and cloud infrastructure providers. We are not liable for failures, interruptions, policy changes, or limitations imposed by third-party providers. Third-party services are governed by their own terms and privacy policies.
18. Electronic Communications
By creating an account, you consent to receive electronic communications from us, including service announcements and account notifications. These communications are part of the Service and you may not opt out of them while maintaining an account. Marketing communications are optional and may be unsubscribed from at any time.
19. Assignment
We may assign or transfer these Terms and our rights under them, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
20. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, wars, terrorism, riots, government actions, power outages, internet or telecommunications failures, cyberattacks, pandemics, or failures of third-party service providers.
21. No Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it later. Any waiver must be in writing and signed by us to be effective.
22. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
23. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and I LIKE BASIC PTY LTD regarding the Service and supersede all prior agreements and understandings.
